Fux Can Revive Brazil’s Lapsed Betting Licenses Retroactively. He Has Not Ruled

The 85 authorizations that let 85 companies run 188 betting brands in Brazil lapsed on October 25, the day of the runoff. The fees paid for them are not refunded. Justice Luiz Fux, the Supreme Court rapporteur on the challenges to Provisional Measure 1.394, has not ruled. If Fux suspends the measure with retroactive effect, the authorizations would count as valid without interruption, as if they had never lapsed. Operators and the National Association of Games and Lotteries (ANJL) filed 19 injunction requests in the federal courts.
